End User License Agreement

The license terms that apply when you download, install, or run any Xocipher Tool.

This End User License Agreement ("EULA") is a legal agreement between you (an individual or the entity you represent, "Licensee") and the individual developer operating Xocipher, based in Sweden ("Licensor", "Xocipher"), governing your use of any software, script, binary, or tool distributed by Xocipher (each, a "Tool"). By downloading, installing, or running a Tool, you agree to be bound by this EULA. If you do not agree, do not download, install, or run the Tool.

1. License Grant

Subject to your compliance with this EULA, Xocipher grants you a limited, non-exclusive, non-transferable, revocable license to install and run the Tool for your own personal or internal use, solely for lawful, authorized security research or bug bounty activity as described in Section 2. No other rights are granted. This license does not include the right to resell, sublicense, or redistribute the Tool unless separately agreed in writing.

2. Permitted Use

You may only use a Tool against:

  • systems, networks, applications, or infrastructure that you own; or
  • systems, networks, applications, or infrastructure for which you hold explicit, documented, prior written authorization to test: for example, assets explicitly listed as in-scope under a bug bounty or vulnerability disclosure program in which you are an enrolled, authorized participant.

You are responsible for keeping evidence of your authorization (such as a program's published scope) and for confirming that your testing activity stays within it.

3. Prohibited Use

You may not use a Tool, and may not permit or assist any third party to use a Tool, to:

  • access, scan, probe, or interact with any system without proper, verifiable authorization;
  • gain or attempt to gain unauthorized access to any computer, network, or data;
  • disrupt, degrade, or deny service to any system or network;
  • create, deploy, or distribute malware, ransomware, or other destructive code using the Tool;
  • exfiltrate, misuse, or unlawfully disclose data belonging to any third party;
  • violate the scope, rules, or terms of any bug bounty or vulnerability disclosure program;
  • violate any applicable law, including computer misuse and unauthorized access laws (such as Sweden's brottsbalken provisions on dataintrång, the U.S. Computer Fraud and Abuse Act, or the UK Computer Misuse Act, as applicable to you); or
  • reverse engineer, decompile, or disassemble the Tool beyond what is expressly permitted by applicable law, or remove any proprietary notices from it.

Xocipher builds these Tools for legitimate, authorized security research. Any use outside the Permitted Use in Section 2, or any use listed above, is a material breach of this EULA and is undertaken entirely at your own risk and legal responsibility.

4. Ownership

The Tool is licensed, not sold. Xocipher and its licensors retain all right, title, and interest in and to the Tool, including all intellectual property rights, except for any third-party open-source components incorporated into it, which remain subject to their own licenses.

5. No Warranty

THE TOOL IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND, EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR NON-INFRINGEMENT. XOCIPHER DOES NOT WARRANT THAT THE TOOL WILL BE ERROR-FREE, SECURE, OR THAT ITS RESULTS (INCLUDING ANY RECON OUTPUT OR GENERATED REPORT) WILL BE ACCURATE OR COMPLETE.

6. Limitation of Liability & No Liability for Misuse

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, XOCIPHER AND ITS OPERATOR SHALL HAVE NO LIABILITY WHATSOEVER FOR HOW THE TOOL IS USED BY YOU OR BY ANY THIRD PARTY, INCLUDING ANY UNAUTHORIZED, ILLEGAL, OR HARMFUL USE. XOCIPHER IS NOT RESPONSIBLE FOR MONITORING, VERIFYING, OR CONTROLLING HOW LICENSEES USE THE TOOL, AND PROVIDING THE TOOL DOES NOT CONSTITUTE ENDORSEMENT OR AUTHORIZATION OF ANY SPECIFIC ACTIVITY YOU UNDERTAKE WITH IT. IN NO EVENT SHALL XOCIPHER OR ITS OPERATOR BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, PROFITS, BUSINESS, OR LEGAL LIABILITY YOU INCUR, ARISING FROM YOUR USE OF THE TOOL, WHETHER OR NOT XOCIPHER HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. WHERE LIABILITY CANNOT BE FULLY EXCLUDED UNDER APPLICABLE LAW, XOCIPHER'S TOTAL AGGREGATE LIABILITY TO YOU UNDER THIS EULA SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID FOR THE TOOL IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) 500 SEK.

7. Indemnification

You agree to indemnify, defend, and hold harmless Xocipher and its operator from and against any and all claims, damages, losses, liabilities, fines, penalties, costs, and expenses (including reasonable legal fees) arising out of or related to your breach of this EULA, your use or misuse of the Tool, or any unauthorized or unlawful use of the Tool by any third party to whom you provided, sold, leaked, or otherwise made the Tool available.

8. Export & Legal Compliance

Security software of this kind may be subject to export control or dual-use regulations in your country (for example, EU dual-use export controls, or equivalent regimes elsewhere). You are solely responsible for determining whether downloading, using, or transferring the Tool complies with export control, sanctions, and other applicable laws in your jurisdiction.

9. Term & Termination

This EULA is effective until terminated. Your license terminates automatically, without notice, if you breach any term of this EULA, in particular the Prohibited Use provisions in Section 3. Upon termination, you must stop using the Tool and delete all copies of it in your possession.

10. Updates & Beta Status

Tools distributed by Xocipher may currently be in early, beta, or "soft launch" status. Features, behavior, and availability may change, and a Tool may be discontinued at any time, without obligation to provide notice, support, or continuity.

11. Governing Law

This EULA is governed by the laws of Sweden, without regard to conflict-of-law principles, and any dispute arising from it shall be subject to the exclusive jurisdiction of the courts of Sweden, unless mandatory consumer protection law in your country of residence provides otherwise.

12. Entire Agreement

This EULA, together with the Terms of Service and Privacy Policy, constitutes the entire agreement between you and Xocipher regarding your use of the Tool, and supersedes any prior agreements relating to it.
